1 - The registered name holder shall provide accurate and reliable contact details to the registrar and correct and update them within seven (7) days of any change during the term of registration of the registered name, including:
- The full name, postal address, e-mail address, telephone number and (if available) fax number of the registered name holder;
- The name of the authorised contact person in the case of a registered name holder that is an organisation, association or company;
- the name, postal address, e-mail address, telephone number and (if available) fax number of the administrative contact person for the registered name;
- The name, postal address, e-mail address, telephone number and (if available) fax number of the technical contact person for the registered name; and
- The names of the primary and secondary nameserver(s) for the registered name.
2 - Deliberate provision of inaccurate or unreliable information by a registered name holder, deliberate failure to update information within seven (7) days of a change, or failure to respond within fifteen (15) days to enquiries from the registrar as to the accuracy of the registered name holder's contact details, shall constitute a material breach of the contract between the registered name holder and the registrar and may result in suspension and/or cancellation of the registration of the registered name.
3 - Any registered name holder intending to licence the use of a domain name to a third party shall remain the registered name holder of record and shall be responsible for providing its own full contact details and for providing and updating accurate technical and administrative contact details sufficient to facilitate timely resolution of issues relating to the registered name. A registered name holder who licenses the use of a registered name under this provision accepts liability for damages caused by unlawful use of the registered name unless it provides within seven (7) days the current contact details provided by the licensee and the licensee's identity to a party providing reasonable evidence of damages.
4 - The registrar must notify any new or renewed registered name holder of:
- the purposes for which any personal data of the applicant are collected;
- the intended recipients or categories of recipients of the data (including the registry operator and others receiving the data from the registry operator);
- which data are mandatory and which data, if any, are voluntary; and
- how the registered name holder or data subject can access and, if necessary, make corrections to the data held about them.
5 - The registered name holder must consent to the data processing referred to in Subsection 4.
6 - The registered name holder certifies that it has provided notification equivalent to that described in Subsection 4 to any third party whose personal data is provided to the registrar, and that the registered name holder has obtained consent equivalent to that referred to in Subsection 5 from such third parties.
7 - The registrar agrees not to process the personal data collected from the registered name holder in a manner incompatible with the purposes and other limitations about which it has informed the registered name holder in accordance with Subsection 4.
8 - The registrar agrees to take reasonable precautions to protect personal data from loss, misuse, unauthorised access or disclosure, alteration or destruction.
9 - The registered name holder declares that, so far as the registered name holder knows and believes, neither the registration of the registered name nor the manner in which it is used, directly or indirectly, infringes the legal rights of a third party.
10 - For the resolution of disputes relating to or arising from the use of the registered name, the registered name holder agrees, without prejudice to other potentially applicable jurisdictions, to submit to the jurisdiction of the courts (1) of the registered name holder's domicile and (2) where the registrar is located.
11 - The registered name holder agrees that the registration of the registered name may be suspended, cancelled or transferred in accordance with any specification or policy rule, or in accordance with any procedure of the registrar or registry operator not inconsistent with any specification or policy rule, (1) to correct mistakes made by the registrar or registry operator in the registration of the name or (2) for the resolution of disputes relating to the registered name.
12 - The registered name holder shall indemnify the registry operator and its directors, officers, employees and agents against all claims, damages, liabilities, costs and expenses (including reasonable legal costs and expenses) arising out of or in connection with the domain name registration of the registered name holder.
13 - The registered name holder acknowledges and agrees that the Registry Operator retains the right to refuse, cancel or transfer registration of any registered name or transaction, or to place registered name(s) in a lock, hold or similar status, at its discretion: (i) to comply with specifications adopted by a generally recognised authority relating to the Internet (e.g. RFCs), (ii) to correct mistakes made by the registry operator or a registrar in connection with a domain name registration, or (iii) for non-payment of fees to the registry operator.
14 - The registered name holder must not distribute malware, abuse botnets, phishing, piracy, infringe trademarks or copyrights, engage in fraudulent or deceptive practices, offer counterfeit goods or engage in activities contrary to the law. Consequences for such activities, including suspension of the domain name, shall be in accordance with applicable laws and procedures.
15 - The registered name holder must comply with ICANN standards, policies, procedures and practices for which the registry operator has oversight responsibility in accordance with the Registry Agreement or other arrangement with ICANN. These policies include, among others, the Uniform Domain Name Dispute Resolution Policy (UDRP), the Uniform Rapid Suspension Procedure (URS) and the Transfer Dispute Resolution Policy. The registered name holder must comply with all applicable national, state or local laws, regulations or court orders relating to its activities and registrations of the Registry TLD.
